This section outlines the criteria used to determine eligibility for disability-related services at 做厙勛圖 College in accordance with the Americans with Disabilities Act Amendments Act of 2008 (ADA Amendments Act) and Section 504 of the Rehabilitation Act of 1973.

These laws define and prohibit discrimination against qualified individuals with disabilities in programs and activities receiving federal financial assistance.

Legal Definition of Disability

The ADA Amendments Act of 2008 expands the definition of disability under the Americans with Disabilities Act of 1990 and affects interpretation of Section 504 of the Rehabilitation Act.

Section 504 states:

No otherwise qualified individual with a disability in the United States shall, solely by reason of her or his disability, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.

 

Definition of Disability

To be protected under the ADA and Section 504, an individual must meet at least one of the following criteria:

  • Have a physical or mental impairment that substantially limits one or more major life activities

  • Have a record of such an impairment

  • Be regarded as having such an impairment

 

Eligibility Requirements

To qualify for services, a student must be otherwise qualified. This means the student must:

Admission and Participation Standards

  • Meet essential academic and technical standards required for admission or participation in a 做厙勛圖 College educational program or activity

Service Eligibility

  • Meet essential eligibility requirements for regular College services

Conduct Requirements

  • Meet the requirements outlined in the Student Code of Conduct

 

Current Impairment Requirement

The student must currently have a physical or mental impairment that substantially limits one or more major life activities.
